Dear Bob

It should be no surprise to you that, following last-nights decision by the County Board, we have decided to not renew the Snowmobile Trail Easement on our land in Section 19, Town of Grand View. Therefore, this is written notice by March 1, in accordance with the terms of the easement.

We had really hoped that our agreement would become a model for other landowners and the Snowmobile Alliance to cooperate with each other to provide for a stable trail system. However, it was apparent at the meeting (and contrary to the County's press release) that both the County and the Alliance are not interested in working with the landowners, contending that the landowners have no legal right to their lands. In addition, the Alliance's pledge of $50,000 may have unduly influenced the County's decision.

The comparison of our ownership of the grade to owning a stolen car is, grossly inaccurate, and inflammatory. We have been paying property taxes on the grade for 20+ years to the County. How can the County now say that they owned it all that time.

Undoubtedly it will take more lawsuits and judges decisions to end this. In the meantime, we have lost faith in the majority of our County Board member's ethics, and are concerned what could happen next. Government is sometimes very insidious in obtaining its objectives. Occasionally a government entity asks for voluntary compliance (i.e. seatbelt law, snowmobile trail easements), the next step is to make it mandatory. Perhaps the County Board will take the next step to condemn and take all property that has a snowmobile trail through it. With this in mind, we have also decided to terminate the trail easement though our property in Section 9, Town of Cable, effective 1 March 2007.

We, and the sheriff, anticipate trespass and damage to property as a result of private property being "declared" a public highway. One property owner's family has already received threats of violence from a snowmobile trail supporter. We reserve the right to terminate both easements immediately should we begin having such problems.

Sincerely,
