County Snowmobile Trails 63 and 13:
Public Highway Issue
WHEREAS, Bayfield County has established public recreational trails for snowmobiling and other limited purposes (Trail 63 and Trail 13) generally along a railroad right-of-way ("corridor") previously used by the Chicago and Northwestern Railroad and its predecessors ("Railroad"); and
WHEREAS, the Railroad acquired its interest in the corridor from the United States; and
WHEREAS, 43 U.S.C. §§ 912-13 authorize Bayfield County to embrace and establish public highways on federally granted railroad rights-of-way, like the Railroad corridor; and
WHEREAS, a healthy tourism business is critical to the economy of Bayfield County and a viable and user-friendly recreational trail system is vital to a healthy tourism business; and
WHEREAS, Bayfield County has adopted a policy of embracing and establishing the Railroad corridor as a public highway for snowmobile and other recreational purposes whenever the County determines such action is necessary to maintain a viable and user-friendly snowmobile trail system; and
WHEREAS, the Tourism and Recreation Committee has found that it is necessary to embrace and establish a public highway along that part of the Railroad corridor as described on the attached Exhibit A; and
WHEREAS, Bayfield County desires to alleviate concern and disruption for private landowners by minimizing the portions of the railroad corridor that it establishes and embraces as a public highway and by disavowing the County's interest in portions of the corridor for which the County determines it has no need;
NOW, THEREFORE, BE IT RESOLVED BY THE BAYFIELD COUNTY BOARD
OF SUPERVISORS:1. The County adopts the findings and recommendation of the Tourism and Recreation Committee.
2. To the extent it has not already done so, the County shall embrace and establish a public highway for snowmobile purposes and such other recreational uses as the County may from time-to-time approve along that part of the Railroad corridor as shown on Exhibit A.
3. The establishment of the public highway shall take effect (or, if previously established, shall be confirmed) upon the filing of an order and a map by the Highway Committee with the county clerk showing the location of the lands being established or confirmed as a public highway. The Highway Committee shall determine the precise width and location of the public highway (within the Railroad corridor) in consultation with the Tourism and Recreation Committee.
4. The Highway Committee is directed to take such action expeditiously.
5. The Tourism and Recreation Committee is directed to continue to explore and, where appropriate and consistent with the public interest; recommend to the County Board: (a) compromises with private landowners; (b) whether there are additional portions of the corridor as to which the County should disavow its interest; and (c) whether there may be additional portions of the Railroad corridor that the County should embrace and establish as a public highway.
